Comptroller's 2010 Report Israeli Law
The following description of the Israel Antiquities Authority, its reason for being, the authority granted it by law, and its responsibility toward the Temple Mount, among other "antiquity sites that are also holy places," are all directly quoted from the official website of the Israel Antiquities Authority.

"With the creation of the State of Israel it was decided to establish the Department of Antiquities (in 1948). In April 1990 the Antiquities Authority was founded, operating in accordance with the Antiquities Authority Law and the Law of Antiquities. We, the workers and administrators of the Antiquities Authority, consider the protection of the country's antiquities a mission of the highest calling, and act to achieve this aim by properly balancing the country's development needs with the safeguarding of its antiquities.

"The Antiquities Law 1978 was enacted in order to protect the antiquities of the country, i.e., any object, which was made by man before 1700 CE, or any zoological or botanical remains from before the year 1300 CE..."

Antiquity Sites that are also Holy Places

Israel, the Holy Land, has many ancient sites sacred to Judaism, Christianity, and Islam, as well as to the Druze and Bahai communities. Holy sites are sometimes dedicated to revered personalities, like the Patriarch Abraham, King David, the Prophet Samuel, Jesus, and the Prophet Muhammad. Several of the holy sites in Israel are also archaeological sites, e.g., the Western Wall, the Temple Mount, the Church of the Holy Sepulchre, and others. Archaeological activities at these sites, which are legally defined as holy sites, are not dependent on the sole discretion of the IAA Director-General. Any changes (e.g., excavation, construction, preservation of ancient walls, etc.) require approval of the Ministerial Committee for Holy Places, which consists of the Ministers of Justice, Education and Religious Affairs. The IAA is responsible for the integrity of these holy sites."

By its own admission, the authority of the IAA is hampered by the political concerns of the two government ministries who sit upon the Ministerial Committee for Holy Places, the Ministries of Justice and Education. (The Religious Affairs Ministry has since been abolished.). In this manner the IAA is stripped of its ability of being able to oversee declared archaeological sites and call for the enforcement of the law of the state of Israel when these archaeological sites are threatened.

And so it is that the archaeological treasures of the first and second Holy Temples that are found on the Temple Mount have been and are being systematically removed and destroyed by the Moslem Wakf. The Israel Antiquities Authority has refrained from calling for the legally required supervision of the Wakf "construction" work, apparently due to government pressure. Those concerned archaeologists who are trying, nonetheless, to view and assess the irreparable damage being caused to the Temple Mount are actively being prevented by the Israeli police presence at the site, who are physically denying them access to the "construction" site. The "construction" site in question happens to be located in the area stretching from the outer altar up to the Sanctuary. The archaeological importance of this area is indisputable.

Archaeology aside, the Wakf aggression against the site of the Holy Temple is an outrage of immeasurable proportions. It is literally a crime against humanity, as the Holy Temple holds out the hope for all mankind. It is a crime against the Jewish people whose Holy Temple was destroyed 2000 years ago by cruel invaders, and who have returned to the land of Israel for the express purpose of restoring to G-d His abode in this world, and renewing the Divine service of the Holy Temple. And it is a crime against G-d Himself, Whose promise of redemption for all mankind is expressed in the words of Isaiah, "... for My house shall be called a house of prayer for all nations."

For all who share with us this feeling of outrage and wish to make your voice heard, we are providing the following telephone and fax numbers to the relevant Israeli government ministries. Please read the suggested messages we have prepared below.

The Israel Antiquities Authority website contains a page for the specific purpose of "reporting an antiquities robbery." We urge you also to take a moment to express your concern to them. Again, we have prepared a suggested text below.

We have also seen fit to reprint in its entirety the text of the Israel Antiquities Law. Inasmuch as it was written up and enacted with the expressed purpose of preventing the crime presently taking place on the Temple Mount, we feel that its contents should be easily accessible to all who are interested. Please click here for the table of contents.

Suggested message:

The Moslem Wakf is systematically destroying Second Temple artifacts on the Temple Mount in broad daylight with Israeli police protection who claim that the Israel Antiquities Authority has sanctioned this wanton destruction. I am asking you to act according to the law of the state of Israel and demand proper archaeological supervision of the Wakf Temple Mount excavation. It is inconceivable that this Taliban-like whole-sale destruction of non-Moslem treasures should be taking place in the state of Israel.
